1. Introduction
Flare is operated by Crelio Tech, Inc. ("Flare," "we," "us"), a Delaware corporation (currently in the process of changing its name to Flare Tech, Inc.) with its registered address at 1111B S Governors Ave STE 52394, Dover, DE 19904, USA. Certain services, including payment processing, may be provided in part through our affiliates, including Digital Trend AS (Norway), during a transition period. This Privacy Policy explains how we collect, use, disclose, and protect your information when you use the Flare website, mobile applications, and related services (the "Services"). We comply with applicable data-protection laws, including the EU/UK General Data Protection Regulation (GDPR) for users in those regions.
2. Information We Collect
2.1 Information you provide
- Account and profile data — name, email address, username, profile photo, account type (creator or business), and, for creators, marketplace profile information you choose to publish (bio, niches, portfolio content, rates, location).
- Business data — organization name, brand details, campaign briefs, and billing information.
- Payment and payout data — payments and creator payouts are processed by third-party payment and payout providers. The provider (identified to you when you make a payment or set up payouts) collects your payment, identity-verification, and banking details under its own privacy policy; we receive limited information such as payout status and account identifiers, not your full card or bank numbers.
- Tax documentation — where required before payouts (e.g., W-9 or W-8 series forms).
- Content and communications — content you upload, posts and comments in platform feeds, messages you send through our messaging features, campaign applications and deliverables, and any communication with our support.
2.2 Information collected automatically
Device data, log and usage data, approximate country and, where available, U.S. metro area derived from network/IP signals, device timezone, language/locale, platform, and interaction data (including applications, uploads, and features used). We may combine repeated coarse signals to estimate the country and metro area from which a Creator is most likely to deliver work; a payout provider's verified country may corroborate the country estimate. We do not retain the raw IP address for this estimate or copy identity documents or full verification addresses into it. Our mobile apps may collect push-notification tokens so we can deliver notifications you enable.
2.3 Social media integration data
When you connect Social Media Accounts (including TikTok, Instagram, YouTube, Facebook, LinkedIn, X, Threads, and Bluesky), we collect and process, per platform: account and profile information (name, ID, avatar), securely stored authentication tokens, content-publishing capabilities you authorize, and content performance metrics (views, likes, comments, reach) for analytics and campaign tracking.
Flare's use and transfer of information received from Google APIs (including YouTube) adheres to the Google API Services User Data Policy, including the Limited Use requirements.
2.4 Publicly available social media data
To measure campaign performance for creators participating in campaigns — including creators who have not connected an account — we may collect publicly available information from social media platforms, such as public post metrics (views, likes, comments) and public profile information. We use this data to calculate campaign results and creator earnings, not for marketing to third parties.
3. Legal Basis for Processing (GDPR)
Where GDPR applies, we process personal data on these grounds: contract (providing the Services you signed up for, including campaigns and payouts), legitimate interests (measuring campaign performance, securing the platform, improving the Services), legal obligation (tax, accounting, and compliance requirements), and consent (where you have given it for a specific purpose, e.g., marketing emails — withdrawable at any time).
4. How We Use Your Information
- Providing and operating the Services — accounts, the creator marketplace, campaigns, feeds, messaging, and scheduling
- Matching creators with relevant campaigns and presenting creator profiles to businesses
- Publishing and scheduling content to your connected accounts at your direction
- Tracking campaign performance and calculating creator earnings
- Processing subscriptions, payments, and creator payouts
- Determining Campaign country or metro eligibility, creator matching, offer economics, market analysis, and fraud or location-manipulation risk from a coarse location estimate
- Sending service communications and the notifications you enable (email, in-app, push)
- Sending promotional content, subject to your consent where required — opt out anytime
- Monitoring, securing, and improving the Services, and preventing fraud and abuse (including detection of artificial engagement)
- Complying with legal obligations
5. How We Share Information
- Between platform users, as the product requires — creator marketplace profiles and relevant performance metrics are visible to businesses; campaign participation details are shared between the creator and the sponsoring business; content you post to feeds or send in messages is visible to its audience.
- Service providers — payment and payout processing, cloud hosting and storage, communications/email delivery, analytics, and AI service providers used to power product features. Providers may only process data to provide services to us.
- Legal — to comply with law or valid legal process, or to protect the rights, safety, and property of Flare, our users, or others.
- Corporate events — in connection with a merger, acquisition, or sale of assets, subject to this policy.
We do not sell your personal information, and we do not share your social media account data with third parties for their marketing purposes.
6. International Data Transfers
We are a U.S. company and process data in the United States and other countries where we or our service providers operate. Where we transfer personal data from the EEA, UK, or Switzerland, we use appropriate safeguards such as Standard Contractual Clauses.
7. Cookies and Tracking Technologies
We use cookies and similar technologies for authentication, preferences, and analytics. You can manage cookies via your browser settings; disabling them may limit certain features.
8. Data Retention
We retain personal information for as long as your account is active or as needed to provide the Services, then delete or anonymize it unless longer retention is required (e.g., tax, accounting, and payout records, which we retain as required by law). For social integrations: authentication tokens are stored only while an account is connected and are deleted when you disconnect it; performance data is retained as needed for campaign accounting and analytics.
9. Security
We implement technical and organizational measures to protect your information — including encrypted storage of authentication tokens, access controls, and monitoring. No internet platform can be 100% secure, and we cannot guarantee absolute security.
10. Minors
The Services are for users 18 and older. We do not knowingly collect personal information from anyone under 18; if we learn we have, we will delete it promptly.
11. Your Privacy Rights
Depending on where you live, you may have rights to: access a copy of your personal data; correct inaccurate data; delete your data; restrict or object to certain processing; port your data in a machine-readable format; withdraw consent at any time; and not be discriminated against for exercising these rights. To exercise any of these rights, contact us at [email protected]. If you are in the EEA or UK and have unresolved concerns, you may lodge a complaint with your data-protection authority. Residents of U.S. states with privacy laws (e.g., California) may exercise the equivalent rights those laws provide; we do not sell or share personal information as those laws define it.

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by posting the updated policy and updating the "Last updated" date, and via email or platform notification where appropriate.
